Child Support

To change or cancel the support you pay for your spouse or for your children, you must obtain a judgment.

At Rupture Québec, we offer different flat rates to modify or cancel support by joint procedures. You will find information about these services below. You will also find all relevant information regarding obtaining a judgment to this effect.

 

These services are only offered in joint proceedings. That is, when you all agree to proceed to get the judgment. Everyone will sign the documents, both parents and children at a pension for children and both spouses during a spousal pension. If you are not in this situation, Rupture Québec will not be able to help you.

 

Note the following about child support payable for one or more children:

 

To have your child support cancelled, all your children must be adult and independent. If not, we will talk about a modification in child support.

If one of the parents is a social income beneficiary. The package by email is not available. In addition, the Minister of Social Security must be notified and the price of the turnkey package or VIP will be increased by a minimum of $ 200 or more, to be determined at the time of the meeting.

 

The adult children will have to sign the consent to judgment.

For an amicable judgment in modification or cancellation of alimony by email, Rupture Québec charges a fee of $ 250 (taxes included) while the courthouse charges $ 154 (non-taxable) for judicial stamp fees. As a result, it will cost you a total of $ 404 to get your judgment with this option.

For an amicable judgment in modification or cancellation of turnkey maintenance, Rupture Québec charges a fee of $ 446 (taxes included) while the courthouse charges $ 154 (non-taxable) for judicial stamp fees. As a result, it will cost you a total of $ 600 to get your judgment with this option.

The Mutual Amendment or Cancellation of Alimony by e-mail means that you are responding to an e-mail questionnaire regarding the information relevant to your file. Subsequently, Rupture Québec sends you all your documents necessary to obtain your judgment by email, within a month, sometimes more during busy periods, as well as the instructions to proceed to get yourself of your judgment. The documents are duly completed and personalized to your situation, all you have to do is sign them. This service does not include any meetings, conversations or emails to answer your questions. This service is only appropriate in the case where you already have an agreement between you regarding your entire file, such as when you decided together to cancel child support because they have become major and autonomous. This is a clerical service of preparation of procedures and documents, no opinion or advice is given within the framework of this service.

For an amicable judgment in modification or cancellation of turnkey maintenance, you will benefit from a single meeting with a lawyer lasting for1 hour, during which we will settle all your file, including the preparation and signing of your procedures. Also, if one of the parties is absent at this meeting, she will have to sign the documents from her side without any assistance from us. In addition, if a second or third meeting is required, there will be an additional fee of $ 100 per additional meeting.

 

The judgment is normally rendered within two to eight weeks of the filing of all proceedings in the Court. However, the Court is not obliged to respect this deadline and it is still possible that the judgment will be rendered later, although it is really unusual.

Rupture Québec does not offer representation services in the event of litigation, dispute, debate in the Court or contested procedures. Moreover, we do not deal with any emergency.
