The judgment of divorce is normally rendered between two and three months after the filing of all proceedings at the Court. However, the Court is not obliged to respect this time limit and, although it is unusual, it is not impossible that the judgment is rendered between six months and one year after the filing of the proceedings
To apply for a divorce in Quebec, you must have lived in Quebec for one year. The place of marriage does not matter.
There are three reasons for seeking a divorce in Canada: adultery, physical or mental cruelty, and living separate from each other for more than a year. It is only the separation of more than one year that makes it possible to present a joint petition for divorce. For your information, you can live separate from each other and cohabit under the same roof for economic reasons and usually for a temporary period. But you must live at different addresses at the time of the introduction of the proceedings.
To obtain your judgment of divorce, your original marriage certificate and, if applicable, your original marriage contract must be written in English or French or translated by an official translation service, or by an authorized translator in Quebec. If you are not in possession of these documents, we charge a fee of $ 50 (taxes included) for each of the documents missing. Thus, you will have to pay 150.00 $, taxes and fees included, if you order us to order the original of your marriage certificate whereas you could do it yourself for a total sum of 31.75 $, if you order the document on Internet.
Rupture Québec does not offer representation services in the event of litigation, dispute, debate in the Court or contested procedures. Moreover, we do not deal with any emergency.
